EMPLOYER TERMS OF USE AND SERVICE AGREEMENT

1. PARTIES AND ESTABLISHMENT OF THE AGREEMENT
This Agreement (“Agreement”) is concluded electronically between MUSTER STATION ERP BUSINESS CORP. (Trust Company Complex, Ajeltake Road, Ajeltake Island, Majuro, MH96960, Marshall Islands) (the “Company”), duly established under the laws of the Marshall Islands, and the natural or legal person registered on the Platform as an employer (the “Employer”).
The Employer’s registration to the Platform, logging in, publishing job postings or accessing candidate data constitutes full acceptance of all provisions of this Agreement.
2. LEGAL NATURE OF THE PLATFORM
The Platform is a technical digital intermediary infrastructure that brings together employers and job-seeking candidates.
The Company:
- Is not an employer or intermediary employer
- Does not guarantee job placement
- Is not a party to employment contracts
- Does not guarantee the accuracy of candidates
- Does not act on behalf of employers
Recruitment processes are entirely the responsibility of the Employer.
3. ACCOUNT, AUTHORITY AND CORPORATE ACCURACY
The Employer undertakes that all information provided during registration is accurate, up-to-date and lawful.
The Company may request additional documents from the Employer where deemed necessary.
The Employer is responsible for all actions carried out through the account.
4. SCOPE OF SERVICES
- Creating and publishing job postings
- Viewing candidate applications
- Communicating with candidates
- Managing candidate evaluation processes
- Using Platform tools
The Company reserves the right to unilaterally modify the scope of services.
5. CONDITIONS FOR ACCESS AND USE OF CANDIDATE DATA
There is no publicly accessible CV pool on the Platform.
The Employer may access candidate data only if the candidate applies for a specific job posting.
The Employer agrees to comply with the following obligations:
- To use candidate data solely for recruitment purposes
- Not to share data with third parties
- Not to copy or reproduce data
- Not to use data to create a database
- Not to use data for commercial gain
- Not to export data outside the Platform
The Employer accepts full responsibility for any unauthorized use of candidate data.
6. PERSONAL DATA PROTECTION AND OBLIGATIONS
The Employer is obliged to process personal data of candidates in accordance with KVKK and international data protection regulations.
The Employer:
- May process data only for specific purposes
- Must store data securely
- Must prevent unauthorized access
- Must delete data when the purpose of processing ends
In case of any data breach, the Employer is obliged to immediately notify the Company.
7. PROHIBITED ACTIVITIES
- Bulk downloading candidate data
- Selling or sharing candidate data
- Sending spam or unauthorized communications to candidates
- Using the Platform for fraudulent purposes
- Creating external data pools
8. RESPONSIBILITY FOR JOB POSTINGS AND CONTENT
The Employer is responsible for the accuracy and legality of job postings.
The Company has the right to remove misleading or unlawful postings.
9. AUDIT AND SANCTIONS
The Company has the right to audit the Employer’s use of the Platform.
In case of violations:
- The account may be suspended
- The account may be terminated
- Legal action may be initiated
10. PRICING AND PAYMENT
The Platform may offer paid or free services.
Paid services are specified separately and the Employer accepts these terms.
11. LIMITATION OF LIABILITY
The Company:
- Does not guarantee the accuracy of candidates
- Is not responsible for recruitment outcomes
- Does not compensate indirect damages
- Cannot be held liable for platform interruptions
12. INTERNATIONAL DATA TRANSFER
Data may be processed on systems located abroad due to the Company’s international structure.
13. TERMINATION OF THE AGREEMENT
The Company may terminate the Agreement unilaterally when deemed necessary.
14. FORCE MAJEURE
No liability shall arise in cases beyond the control of the parties.
15. GOVERNING LAW
This Agreement is governed by the laws of the Marshall Islands.
16. EFFECTIVENESS AND ACCEPTANCE
This Agreement enters into force when the Employer registers, logs in, publishes a job posting or accesses candidate data on the Platform.
By using the Platform, the Employer:
- declares that they have read all terms,
- understood them,
- accepted them with free will
and expressly acknowledges the above.
