JOB SEEKER TERMS OF USE AND MEMBERSHIP AGREEMENT

1. PARTIES AND ESTABLISHMENT OF THE AGREEMENT

This Terms of Use and Membership Agreement (“Agreement”) is concluded electronically between MUSTER STATION ERP BUSINESS CORP. (Trust Company Complex, Ajeltake Road, Ajeltake Island, Majuro, MH96960, Marshall Islands) (the “Company”), duly established under the laws of the Marshall Islands, and the natural person using the Platform (the “User”).

The User’s access to the Platform, creation of an account, uploading of content, or use of any Platform services constitutes that the User has read, understood and expressly accepted all provisions of this Agreement.

2. NATURE AND LEGAL STATUS OF THE PLATFORM

The Platform is a technical digital intermediary infrastructure that brings together job seekers and employers.

The Company:

  • Is not an employer
  • Is not a party to employment contracts
  • Does not guarantee employment
  • Is not a representative or agent of employers
  • Does not guarantee the accuracy of job postings

All recruitment, evaluation and contractual processes carried out through the Platform take place directly between the User and the Employer.

3. MEMBERSHIP AND ACCOUNT CREATION

The User agrees to the following when registering on the Platform:

  • That they are at least 18 years old
  • That the information provided is accurate, complete and up to date
  • That they will keep their account credentials confidential

The User is responsible for all actions performed through their account.

The Company reserves the right to suspend or terminate the User account for reasons of security, misuse, illegality or to protect platform integrity.

4. SCOPE AND LIMITATIONS OF SERVICES

The Platform may provide the following services:

  • Creating and managing CVs
  • Viewing and filtering job postings
  • Submitting job applications
  • Communicating with employers
  • Automated matching and recommendation systems

The Company reserves the right to unilaterally modify, expand, limit or terminate the scope of services.

5. RULES OF USE AND OBLIGATIONS

The User agrees to comply with the following obligations:

  • Acting in accordance with the law and good faith
  • Not providing misleading or false information
  • Not violating the rights of third parties
  • Not damaging the technical infrastructure of the Platform

6. PROHIBITED ACTIVITIES

The User may not perform the following actions:

  • Creating fake or misleading CVs
  • Using another person’s identity or documents
  • Using bots, scripts or automated data extraction tools
  • Attempting unauthorized access to the Platform
  • Collecting or selling Platform data without authorization

In such violations, the Company has the right to immediately terminate the account.

7. CANDIDATE DATA AND SHARING MODEL

There is no publicly accessible candidate database (CV pool) on the Platform.

Personal data and profile information belonging to the User: are shared with the relevant employer only when the User applies for a specific job posting.

Employers cannot access User data unless an application is submitted.

The User accepts that their data will be shared with the relevant employer when applying.

8. CONTENT AND CV RESPONSIBILITY

The User is responsible for the accuracy and legality of all content uploaded to the Platform.

The Company is not obligated to verify the accuracy of content.

The Company has the right to remove unlawful content.

9. INTELLECTUAL PROPERTY RIGHTS

All software, design, trademarks and content on the Platform belong to the Company.

The User may not copy or use the Platform for commercial purposes without authorization.

10. PRICING AND PAYMENT

The Platform may offer free or paid services.

Paid services are specified separately and the User proceeds by accepting these terms.

11. LIMITATION OF LIABILITY

The Company:

  • Is not responsible for employer behavior
  • Does not guarantee employment outcomes
  • Does not guarantee uninterrupted operation of the Platform
  • Cannot be held liable for indirect or consequential damages

12. PERSONAL DATA AND PRIVACY

Personal data is processed in accordance with the Information Notice and Privacy Policy.

13. INTERNATIONAL DATA TRANSFER

User data may be processed by servers and service providers located abroad due to the Company’s international structure.

14. TERMINATION OF THE AGREEMENT

The Company may terminate the Agreement unilaterally.

15. FORCE MAJEURE

No liability shall arise from events beyond the control of the parties.

16. GOVERNING LAW

This Agreement is governed by the laws of the Marshall Islands.

17. EFFECTIVENESS AND ACCEPTANCE

This Agreement enters into force at the moment the User first accesses the Platform, creates a membership, or benefits from any Platform services.

By using the Platform, the User:

  • declares that they have read all provisions of this Agreement,
  • fully understood all provisions,
  • accepted them freely without any hesitation or coercion

The User expressly declares and undertakes the above.

The invalidity of any provision of the Agreement shall not affect the validity of the remaining provisions.

The Company reserves the right to update the terms of the Agreement. The updated version becomes effective upon publication on the Platform.
